The present Leave to Appeal under Section 378(4) Cr.P.C. has been filed against the Order dated 03.06.2017 passed by the learned Trial Court in Complaint Case NO.48447/2016.

It is submitted that reliance has been placed on two documents, DW2/4 and DW2/5, one of which is a hand written document and both are on plain paper and do not bear the stamp of the Company, despite which finding has been returned that there is no legal enforceable debt. 5.

For the reasons stated, the Leave Petition is allowed. Appeal be registered.
