CONT.CAS(C) 910/2018 Non compliance of order of 24th September, 2018 is alleged in this petition. Vide aforesaid order, respondents were directed to release the withheld amount of ₹65,90,794/- alongwith interest accrued thereon. Upon notice, learned additional standing counsel for respondents has handed over a copy of 'Minutes of Meeting of the Refund Approval Committee' dated 6th December, 2018 to submit that the withheld amount of ₹65,19,794/- alongwith interest @ 6% per annum i.e., ₹6,37,688/- would be released at the earliest. It is stated by standing counsel for respondents that the approved refund amount with interest would be released by way of refund order to petitioner within two weeks. CONT.CAS(C) 910/2018
According to petitioner's counsel, the amount which is to be refunded is ₹65,19,794/- and alongwith interest, the amount to be refunded comes to ₹72,23,932/-.
In light of the above, this petition is disposed of with direction to respondents to comply with aforesaid undertaking within four weeks, failing which petitioner would be at liberty to get this petition revived. Petitioner is also at liberty to dispute the quantum of the refunded amount by making Representation to first respondent. If any such Representation is received by first respondent then it be dealt with, by giving a speaking response to it.
With aforesaid directions, this petition is disposed of. Copy of this order be given dasti under the signatures of Court Master to counsel for the parties.
