By way of detailed order dated 16.05.2023, the predecessor bench had granted the respondent/landlord liberty to proceed with the execution of the impugned eviction order and for recovery of the use and occupation charges, arrears whereof are stated to be approximately Rs.43,20,000/-. It is further submitted by learned counsel for respondent that possession of the subject premises also stands restored to the respondent/landlord in execution proceedings. Apparently, that is the reason that for past three dates none has appeared for petitioner.

Considering the above circumstances, the petition as well as all pending applications are dismissed in default.
