The instant second appeal has been preferred by the original defendant against a suit for recovery initiated by the respondent, herein. The prayer sought in the instant second appeal reads as under:- "It is therefore requested Decree dated 30-06-2015 in appeal of Rs. 70,000/- alongwith @ interest 12% per annunri passed by the Ld. Sh. Brijesh Sethi, ASJ., Saket Court, New Delhi may kindly be set-a-side." 2.

Upon examining the record, it is seen that the dispute herein, pertains to the recovery of amount against certain cheques, which according to the original defendant, were provided as security against a loan availed. 3.

Upon hearing the parties extensively, on 01.10.2024, the parties have expressed their intention to settle the dispute amicably. Pursuant to the earlier directions, the original defendant has handed over a demand draft dated 14.10.2024 bearing No.530141 for a sum of Rs.60,000/- to learned counsel for the respondent.

In view of the aforesaid, the impugned judgment and decree stands set aside. 6.

Accordingly, no further directions are required to be passed. The appeal stands disposed of along with the pending application.
