This application is filed on behalf of the Plaintiff for withdrawal of the suit in light of the Settlement Agreement executed between the parties on 20.08.2025, copy of which has been placed on record. As per the terms of the settlement, after withdrawal of the suit, Defendant is to pay a sum of Rs. 85 lakhs to the Plaintiff on production of a certified copy of the order passed by this Court permitting withdrawal of the suit. 2.

Court has perused the terms of the settlement and finds the same to be lawful.

Accordingly, this application is allowed permitting the Plaintiff to withdraw the suit.

Application stands disposed of.

Registry is directed to draw up the decree sheet. 8.

Since matter has been settled between the parties, Plaintiff is held entitled to refund of 50% of Court fee.
