% 10.12.2018 Ms.Arya, learned APP states that the present petition is not maintainable as the petitioner has the statutory remedy to file a revision under Section 397 Cr.P.C.

In view of the aforesaid objection, learned counsel for the petitioner prays for leave to withdraw the present petition with liberty to file a revision before the learned Additional Sessions Judge. The petition and applications are dismissed as withdrawn with liberty as prayed for.
