versus DIRECTORATE OF EDUCATION GOVT. OF NCT OF DELHI ..... Respondent Through:

CORAM:

HON'BLE MR. JUSTICE C.HARI SHANKAR ORDER (ORAL) % 21.02.2019 1.

This writ petition has been filed at a stage when the petitioner is facing a show cause notice dated 22nd September, 2017. No order, adverse to the interests of the petitioner, has been taken as yet by way of the adjudication of the said show cause notice. 2.

Learned counsel for the petitioner emphatically contends that similar matters are pending before this Court. However, he confesses his inability to state with certainty that those are cases in which the Court has been approached at the stage of issuance of show cause notice.

W.P.(C) 13207/2018

3.

In the circumstances, I am of the view that the interests of justice would be subserved if this writ petition is disposed of with a direction to the Directorate of Education to take a decision on the show cause notice dated 22nd September, 2017, within a period of four weeks, after grant of adequate opportunity to the petitioner to establish its case, which would include an opportunity of personal hearing. 4.

Needless to say, in case the decision on the show cause notice is adverse to the interests of the petitioner, the petitioner would be at liberty to adjudicate his grievance thereagainst, in accordance with law, if so advised.

C.HARI SHANKAR, J FEBRUARY 21, 2019/kr W.P.(C) 13207/2018
