% 12.12.2018 The petition as presented is clearly defective in as much as inspite of directions in the order dated 08.08.2016 in WP (Crl.) 2316/2016, the wife and daughter of the petitioner have not been impleaded as parties.

The counsel for the petitioner now submits that he may be permitted to withdraw the captioned petition seeking liberty to file afresh after removing the defect and adding necessary averments in such regard.

The petition is dismissed as withdrawn with liberty as prayed for granted.
