M.A. No. 19644/2017 (stay) Learned counsel for the petitioner has contended that petitioner had left India on 23rd August, 2016 for United States of America. He returned on 20th September, 2016. Photocopy of the passport has been annexed with the petition. Learned counsel for the petitioner submits that petitioner shall appear before the trial court on the date fixed, that is, 5th December, 2017. Since petitioner undertakes to appear before the trial court on 5th December,

2017 and participate in the proceedings; impugned order is set aside. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
