O R D E R
% 30.07.2019 The petitioner has preferred the present writ petition assailing the order dated 10.01.2017 passed in O.A. No. 4040/2016, whereby the petitioner's Original Application has been rejected by the Central Administrative Tribunal, Principal Bench, New Delhi (CAT/ Tribunal) on the ground that it did not have territorial jurisdiction in the matter. The petitioner also assails the further orders passed subsequently thereto on the petitioner's review application.
The petitioner, admittedly, is an employee of Sikkim Government and the National East Electrical Power Corporation Limited (NEEPCO). His dispute is with the NEEPCO. The reliefs sought in the Original Application are the following:
"(i) to direct secretary, Sri Benzamine to hand over the Govt Gazette for regularization of Director of North eastern electrical power corporation limited, Minister of power, shram shakti bhawan, New Delhi.
(ii) To Direct secretary, Lepcha to hand over Govt Gazette for regularization of Chairman, Minister of power, Govt. of Sikkim, Shram shakti bhawan, New Delhi.
(iii) grant such other relief's and interim relief as this Hon'ble Tribunal may deem fit and proper as on the facts and circumstances of the case."
The aforesaid show that the petitioner's entire cause of action has arisen outside the jurisdiction of the Tribunal. For the aforesaid reason, the Tribunal has rejected the Original Application on the grounds of territorial jurisdiction.
We do not find any error in the said order passed by the Tribunal. The writ petition is, accordingly, dismissed. It is left open to the petitioner to agitate his rights before a forum which has jurisdiction. Dismissed.
