O R D E R
% 29.11.2017 Learned counsel for the petitioners submits that initially FIR No. 676/2017 under Sections 341/354/323/34 IPC was registered at police station Shakarpur, on the complaint of Ms. Silki/complainant. Complainant was known to the petitioners.
Subsequently offence under Section 328 IPC has been added.
Complainant has alleged in the FIR that petitioner no.1 was known to her for the last four years. On 2nd November, 2017, one person by the name of Pawan Gupta told her that petitioner no.1 had been calling her at his house.
She went to his house where petitioner no.3 (sister-in-law of petitioner no.1) brought water for her.
After drinking the water she felt giddiness. Petitioner no.2 (brother of petitioner no.1) caught hold of her hand and pushed her. She released herself and came out of the house and raised alarm. PCR van arrived there and took her to Lal Bahadur Hospital. Learned counsel for the petitioner further submits that complainant was
conscious and well oriented when police took her to the hospital. No external injuries were found on the person of complainant. Complainant had stated before the doctor that some unknown substance was given to her, however, no opinion was given by the doctor as to what kind of substance was given, inasmuch as, gastric wall was not taken to identify the alleged substance. It is further submitted that complainant had been blackmailing the petitioners. She had been making threatening calls to the petitioner no.2 and one Sarita (sisterin-law of petitioner nos. 1 and 2), which have been recorded by the petitioners. CDR along with transcripts have already been given to Investigating Officer. Keeping in mind totality of the facts and circumstances, it is ordered that in case of arrest, petitioners be released on bail subject to their furnishing a personal bond in the sum of `20,000/- each with one surety each of the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station.
Bail application is disposed of in the above terms. Dasti.
