% 13.02.2018 This is a petition under Article 226 of the Constitution of India filed by the petitioner, who claims to be a regular street vendor and has been vending opposite Shop no.171, near Mandir in Sarojini Nagar Market, New Delhi. Counsel for the petitioner, at this stage, submits that the petitioner would be satisfied if leave is granted to the petitioner to approach the Town Vending Committee(TVC) as and when it is functional. She seeks a direction to the TVC to consider the case of the petitioner in accordance with law and expeditiously. Counsel for the respondents without admitting any of the averments made in the writ petition submits that in case the petitioner approaches the TVC as and when it is functional with all supporting documents, the case of the petitioner would be considered in accordance with law.

Binding the parties to the statement made in Court, the writ petition is disposed of, as prayed.

We make it clear that in case the petitioner is not found vending at the site when the survey is conducted, that alone would not be a ground to reject his case.

CM.APPL 43661/2017 also stands disposed of.
