Bail Appln. No. 2454/2017 This is the first application filed by the petitioner under Section 439 Cr.PC seeking interim bail in case FIR No. 279/2016 under Section 302/411 IPC registered at Police Station - Mayur Vihar, Delhi. Learned counsel for the petitioner submits that the petitioner is an innocent girl and has been falsely implicated in the instant matter; that the petitioner is in judicial custody for last more than 1 year, investigation is complete and material witnesses have been examined before the Trial Court; that petitioner has applied for Preliminary Examination (CWE) for recruitment of Clerical Cadre which is scheduled to be held on 27.11.2017; that vide order dated 24.11.2017, the Trial Court granted petitioner to
appear in the said examination in the custody of police officials which she refused as it detrimental her performance to appear in custody with police officials.
Status report has been filed. As per the status report, call letter of the petitioner for the Recruitment of Clerical Cadre has been checked online at the Web site of Institute of Banking Personnel Selection (www.ibps.in) and the same is found to be correct and genuine.
Keeping in view the facts and circumstances of the present case, the petitioner is directed to be released on interim bail subject to : i) That applicant shall furnish a personal bond in the sum of Rs.30,000/- with one local surety of like amount to the satisfaction of the concerned Trial Court;
ii) That petitioner shall be released on 04.12.2017 latest by 4:00 p.m.;
iii) That the petitioner shall surrender before the concerned Jail Superintendent, immediately after expiry of the period of interim bail i.e. 11.12.2017 before 4:00 p.m.
iv) That the applicant shall not leave the territorial jurisdiction of Delhi NCR without the prior permission of the Trial Court; v) That the applicant shall not directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the present case so as to dissuade them from disclosing such facts to the Court or to any other authority; vi) that the applicant shall provide her mobile phone number to the Jail Superintendent at the time of his release, which shall be kept
in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent; vii) That petitioner shall not indulge herself in any other criminal activity during the period of interim bail.
Application stands disposed of.
Copy of the order be given dasti under the signatures of Court Master. A copy of this order be communicated to the concerned Jail Superintendent.
