By this application the petitioner seeks extension of parole granted to him vide order dated 4th December, 2017 and extended thereafter for the reason that he had to make necessary arrangements for the shifting of the studies of his daughter.
Petitioner had filed the present writ petition on the ground that his father was in ICU and he had to look after the father besides the minor daughter aged 14 years who was studying in 7th Class. This Court vide order dated 4th December, 2017 granted parole to the petitioner for a period of four weeks. However, the father of the petitioner passed away on 8th December, 2017. Thus, the petitioner sought extension of the said parole by filing W.P.(CRL) 3365/2017
Crl.M.A. 105/2018, when again an extension of parole was granted to the petitioner.
The State has already verified that the parents of the petitioner have passed away and thus there is no one in the family to look after the minor daughter of the petitioner who is now studying in 7th standard. The petitioner who is present in Court states that he has verified from two Boarding Schools and the examination of his daughter would be conducted in March, 2018 where after she can be admitted in the 8th standard and in case the petitioner hurries up and gets her admitted mid-term, his daughter will have to waste one year and will be admitted in the next term only in 7th standard.
Considering the verification reports already filed and the peculiar facts that there is no one to look after the minor daughter of the petitioner in the family, this Court deems it fit to grant further extension of parole. For the reasons noted above, the parole granted to the petitioner vide order dated 4th December, 2017 and extended vide order dated 5th January, 2018 is extended for a further period of 8 weeks on the same terms and conditions as imposed vide order dated 4th December, 2017.
It is clarified that the petitioner will make necessary arrangements for the lodging of his minor daughter in the Boarding School within 8 weeks and no further extension would be granted on this count. Application is disposed of. Order dasti.
