% 19.01.2018 Crl. M.A. No. 21414/2017 (modification of order dated 1st December, 2017) 1.

By this application the appellant seeks modification of order dated 1st December, 2017 for the reason that the petitioner is not in a position to furnish a surety bond in the sum of ₹20,000/-. A perusal of the nominal roll reveals that the petitioner has been released on parole and furlough on number of times. Order dated 15th July, 2015 passed by this Court in W.P. (Crl.) 1435/2015 reveals that the petitioner was granted parole for filing special leave petition on his furnishing a personal bond in the sum of ₹15,000/- with one surety of the like amount. The petitioner furnished the surety bond and was thus released.

Considering the earlier order passed by this Court in W.P. (Crl.) 1435/2015 the order dated 1st December, 2017 is modified. Rest of the terms and conditions remaining the same, the petitioner will now be released on furlough for a period of three weeks from the date of his release on his furnishing a personal bond in the sum of ₹15,000/- with one surety of the like amount, subject to the satisfaction of the Superintendent, Tihar Jail. 3.

Application is disposed of.
