% 08.02.2018 Learned counsel for the petitioner submits that as per clause 32 of the tender document, if any dispute arose between the parties, it shall be referred to the sole arbitration of the person appointed by the Secretary, Ministry of Broadcasting, Government of India, Prasar Bharti. It is submitted that the petitioner issued notice of invocation dated 26.8.2017 to which no reply was filed by the respondent. Hence this petition.
In the circumstances, Mr.Rakesh Siddharth, District Judge (Retd.) (Mobile No.9910384655) is appointed as the arbitrator to arbitrate the dispute. The fee shall be fixed as per DIAC Rules. The petition is disposed of.
