Vide the present bail application u/s 439 CrPC, the petitioner seeks grant of regular bail.

As per the allegations in the FIR, the petitioner had befriended the complainant in 2013. In or around March, 2013, the petitioner had called the complainant to his house, where he was alone at the time and had offered her some tea. After drinking the tea offered by the petitioner, the complainant became unconscious and the petitioner allegedly clicked various nude photographs of her from his mobile phone, which he is now threatening to circulate after their relationship had gone sour.

Pursuant to notice being issued on the last date, a status report has been filed by the respondent from which it transpires that the petitioner and the complainant were known to each other for a very long time and till date no incriminating material has been found by the Investigating Officer.

Having perused the record and in view of the fact that the

petitioner has already been in custody for over four months, but without commenting on the merits of the case, I am of the view that he has made out a case for being released on bail. Accordingly, it is directed that the petitioner be released on bail, subject to his furnishing a personal bond in the sum of Rs.25,000/- with a surety of the like amount to the satisfaction of the learned Trial Court. The petitioner will not leave the NCR without the prior permission of the learned Trial Court and will not try to contact any of the witnesses or hamper the trial in any manner. The petitioner will also furnish two mobile phone numbers on which he can be contacted to the Investigating Officer. The aforesaid mobile numbers will be kept operational at all times.

Needless to state that the observations made hereinabove are only prima facie and will not have a bearing on the trial. 6.

A copy of the order be sent to the concerned Jail Superintendent.

The bail application is disposed of in the above terms. Dasti.
