% 02.02.2018 Notice could not be issued to the respondent no. 2 as process fee was not filed. However, respondent no. 2 is present in Court and accepts notice. Respondent no. 2 has been identified by SI Jivant of Police Station Kalyanpuri. Respondent no.2 is submits that petitioner is his landlord. He submits that he has settled the matter of his own free will, voluntarily and without any undue force, pressure or coercion, vide a Compromise Deed dated 7th November, 2017. Respondent no. 2 says that he has now vacated the tenanted premises and he has no objection in case FIR is quashed against the petitioner, in view of the settlement. Affidavit of respondent no.2 is also
on record, wherein he has stated that he has no objection if FIR is quashed. Keeping in view the settlement arrived at between the petitioner and respondent no. 2, in the interest of justice, FIR No.264/2016 under Sections 380/448/509 IPC registered at Police Station Kalyanpuri and the consequent proceedings emanating therefrom are quashed.
