The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.423/2017 registered under Section 376 IPC at PS Bhalswa Dairy. Status report is on record.

I have heard the learned counsel for the parties and have examined the file.

The petitioner is in custody since 25.07.2017. Charge-sheet has already been filed. The prosecutrix and the petitioner were acquainted with each other prior to the incident. The prosecutrix was a married lady. Physical relations took place between the two on several occasions. Allegedly, the prosecutrix was sexually assaulted on several occasions on the promise to marry. It is on record that the petitioner is also married and has children.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.
