By way of this application filed under Section 438 Cr.P.C., the petitioner is seeking anticipatory bail in FIR No.316/2017, under Section 308/323/34 IPC, registered at PS Patel Nagar. 2.

On behalf of the State it is informed that the petitioner has joined investigation but prayer for anticipatory bail is opposed on the ground that the injury was allegedly caused by the petitioner, hence, he cannot claim parity with the other co-accused who have already been released on anticipatory bail.

Learned counsel for the petitioner submits that the petitioner himself suffered injuries in this occurrence and the cross case has been registered in respect of the injuries suffered by him.

Taking into consideration that the petitioner is not required for custodial interrogation, he himself suffered an injury for which cross case has been registered and the nature of the injuries suffered by the BAIL APPLN. 2465/2017

complainant in this case is simple, in the event of arrest, the petitioner is directed to be released on bail on his furnishing a personal bond in the sum of `50,000/- with one surety of the like amount to the satisfaction of the IO/SHO concerned.

Petitioner is directed to join the investigation as and when required by the Investigating Officer.

Copy of the order be given dasti to the learned counsel for the petitioner.
