% 20.12.2017 By this petition the petitioner seeks bail in case FIR No. 291/2017 under Section 307/323/342/506/120B IPC registered at PS Patel Nagar on the complaint of one Ms. Rachna wherein she alleged that one Vishal @ Vishu @ Chintu S/o Rakesh Kumar was his friend who had borrowed money from her but did not return. She had also gifted him an I-phone. Recently Vishal stopped picking her phones and when she demanded the Iphone back, the alleged persons insulted her several times. On 14th September, 2017 at around 10.00 PM the complainant saw Vishal @ Vishu in main market and demanded her mobile phone back. Vishal called his brother i.e. the present petitioner and both of them assaulted the BAIL APPLN. 2478/2017

complainant. Thereafter the complainant was forcefully taken to the second floor where both the brothers were waiting and she was thrown from the second floor of the flat which caused her several injuries. A perusal of the MLC reveals that there is abrasion on the right elbow and tenderness of the right ankle. Apparently the injuries noted on the complainant would not be the only injuries inflicted in case the complainant was thrown from second floor. Further, pursuant to investigation chargesheet has already been filed. Considering the nature of injuries received by the complainant which is abrasion on right elbow and tenderness on the right ankle, this Court deems it fit to grant bail to the petitioner.

It is therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/ CMM concerned, further subject to the condition that he will not leave the country without the prior permission of the Court concerned and in case of change of address the same will be duly intimated to the learned Trial Court by way of an affidavit. Petition is disposed of. Order dasti.
