$~23 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(CRL) 3398/2017 SUDHIR ..... Petitioner Through :
Ms.Inderjeet Sidhu, Advocate.
versus STATE ..... Respondent Through :
Mr.Jamal Akhtar, proxy counsel for Mr.Rahul Mehra, Standing Counsel with SI Omveer Singh.
CORAM:
HON'BLE MR. JUSTICE S.P.GARG
O R D E R
% 11.05.2018 1.
The instant writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been preferred by the petitioner to seek parole for a period of three months to provide medical treatment to his mother. Status report and additional status report are on record.
2.
As per additional status report furnished by the State, it revealed that the petitioner's mother was not suffering from any disease.
No medical documents regarding her illness have been placed on record. Learned counsel was requested to place on record certain medical documents; she expressed petitioner's inability to produce any such document as his mother lived in the village.
3.
Nominal Roll dated 22.11.2017 reflects that earlier the petitioner was granted interim bail w.e.f. 05.10.2011 to 03.11.2011 by this Court but he jumped it and could be re-arrested in another case on 12.05.2012.
Again, he was granted parole from 24.02.2016 to 23.03.2016; he did not surrender in time and surrendered himself after a considerable delay on 24.08.2016 in the Court. 4.
Considering the facts and circumstances of the case, no sufficient ground for grant of parole at this stage. The writ petition is dismissed.
