% 03.08.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court along with counsel and accepts notice. She has been identified by ASI Puran Singh of police station Gokul Puri. Respondent no.2 submits that she has settled all her disputes with the petitioners of her own free will and without any undue force, pressure or coercion, before the Counselling Cell, Family Courts, North East District, Vishwas Nagar, Delhi on 23.12.2016. She further submits that her marriage with petitioner no.1 has been dissolved by a Decree of Divorce dated by mutual consent 12.09.2017 by Family Court, North East District,
Karkardooma Courts, Delhi.
The petitioner no.1 has paid a sum of `1,00,000/- vide a demand draft, copy whereof has been placed on record. Respondent No.2 further submits that she has already received entire settled amount from the petitioners, therefore, she has no objection in case FIR No.390/2012 under Sections 498A/406/34 IPC registered at police station Gokul Puri and the consequent proceedings are quashed against the petitioner and his relatives.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of, in the above terms. Miscellaneous appearance is disposed of as infructuous.
