% 22.01.2019 Learned counsel for the petitioner submits that he has been recently engaged and he has already filed his vakalatnama on 21.01.2019 vide diary no.72301. Inter alia it has been submitted on behalf of the petitioner that the suit CS 78464/2016 out of which the impugned order dated 05.09.2017 arises, has already been dismissed by the learned trial Court and that an appeal in relation thereto has been filed on behalf of the petitioner thus, it is sought that the present petition be allowed to be withdrawn with liberty to make submissions in relation to the impugned order dated 05.09.2017 in the appeal itself and to challenge the same therein. The petition is thus dismissed as withdrawn with liberty granted as prayed.
