The petitioner, by this petition, seeks interim bail in case FIR No. 225/2013 under Sections 302/201/323/34 IPC registered at Police Station Samaipur Badli, New Delhi for a period of two months. It is contended that the petitioner requires to sell a property to arrange money for his family.

The application is opposed by learned Addl. PP who contends that earlier also a similar permission was granted and petitioner was enlarged on interim bail, however, enquiry has revealed that no sale of property was completed. The Investigating Officer has even made enquiries and recorded the statement of earlier prospective buyer - Sandeep Gahlot who stated that he did not have sufficient funds for purchase of property and therefore no transaction was completed. 3.

Learned Addl. PP for the State submits that the trial in the BAIL APPLN. 2479/2017

matter is progressing and 27 out of 33 witnesses have been examined and the prosecution witnesses recorded so far have supported the case of the prosecution and there is great likelihood that petitioner shall abscond or flee from justice. He further submits that no description or details of the prospective buyer has been provided in respect of the sale which is now proposed to be conducted.

Learned Addl. PP further submits that in case any document is sought to be executed, the State is willing to take the petitioner in custody for the purposes of executing the transfer documents and facilitating the sale.

Learned counsel for the petitioner seeks leave to withdraw the application with liberty to file afresh after the deal is finalised. 6.
