% 01.12.2017 The petitioner claims to be a regular street vendor vending in front of 16 U.B. Jawahar Nagar, New Magadi PS Roop Nagar. He seeks a direction to the respondents not to disturb him from his site. Counsel for the respondent/North Delhi Municipal Corporation enters appearance on advance copy and submits that an earlier W.P.(C) 9210/2017 was filed and the same was disposed of on 17.10.2017. The petitioner had sought a direction to approach the Town Vending Committee (TVC) as and when it is functional. He submits that the second writ petition with an identical prayer would not be maintainable. We find force in the submissions made by the counsel for the respondent. An identical relief was sought by filing W.P.(C) 9210/2017 and the additional relief which was sought was that the petitioner would approach the TVC. We find the second petition is not maintainable. The writ petition along with the pending application is dismissed with cost of Rs.2500/- to be deposited within two weeks with the Delhi High Court Legal Services Committee. Dasti.
