% 26.11.2018 By this petition filed under Section 482 Cr.P.C., the petitioner has prayed quashing of the FIR No. 554/2007 under Section 381/420/467/468/471/120 IPC Police Station Connaught Place, New Delhi and consequent proceedings.

In view of the settlement arrived at between the petitioner and the respondent No.2 vide settlement agreement dated 28.11.2017 which has been placed on record, the petitioner was to make the payment to the respondent no.2 in instalments, schedule whereof has been detailed/reproduced in the order dated 13.12.2017. The last installment was payable by 10th August, 2018. Admittedly, the schedule has not been adhered to by paid by the petitioner. Still Rs.11 lakhs is due and payable. For the forgoing reasons FIR cannot be quashed at this stage on the ground of settlement.

The petition is dismissed.
