This suit is allowed to be withdrawn as prayed with liberty to the plaintiff to urge all issues of facts and law as defences in any proceedings which the defendant no.1-bank would initiate against the plaintiff under the Recovery of Debts and Bankruptcy Act, 1993 or Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

Since the suit is withdrawn before recording of evidence therefore plaintiff is held entitled to refund of 50% of the court fee under Section 16-A of the Court-Fees Act, 1870 (as applicable to Delhi).
