The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, praying that an arbitrator be appointed to adjudicate the disputes that have arisen between the parties in relation to an agreement dated 05.03.2014. 2.

Admittedly, the said agreement includes an arbitration clause. The learned counsel appearing for the respondent has no objection if an independent arbitrator is appointed as there is no dispute as to the existence of the agreement dated 05.03.2014. The learned counsel also requests that the arbitration be conducted under the aegis of the Delhi International Arbitration Centre (DIAC).

With the consent of the parties, Mr Dinesh Dayal, (Mobile No.

9810100200), former ADJ is appointed as a Sole Arbitrator to adjudicate the disputes between the parties. This is subject to the Arbitrator making the necessary disclosure under Section 12 of the Act and not being ineligible under Section 12(5) of the Act. It is further directed that the arbitration shall be conducted under the aegis of Delhi International Arbitration Centre (DIAC) and in accordance with its Rules. The parties shall appear before the Coordinator, DIAC on 21.05.2018 at 11:00 AM. 4.

The petition is disposed of.
