O R D E R

% 20.02.2018 The dispute between the parties arises out of marital discord, the first petitioner being the wife of the respondent, the other petitioners being the children born out of their wedlock. The respondent has filed a divorce petition which is registered as HMA No.1127/2017 against the first petitioner which is presently pending in the court of Principal Judge, Family Court for South District at Saket Courts, Delhi, he being a resident of said area, the place of his residence being the last matrimonial home where the parties lived together.

The petitioner, on the other hand, has shifted the residence to Sector 7, Rohini, Delhi which falls within the territorial jurisdiction of Family Court for North-West District at Rohini Delhi where the application of the petitioners seeking award of maintenance in terms of Section 125 of the Code of Criminal Procedure, 1973 is pending.

TR.P.(C.) 226/2017

In these circumstances, the prayer is granted. The divorce case as aforementioned shall stand transferred to the court of Principal Judge, Family Court for North-West District at Rohini, Delhi. The transferor court shall send the file, complete in all respects, to the transferee court, fixing an appropriate date for the parties to appear there. The petition stands allowed.
