O R D E R

% 01.03.2018 This petition under Section 11 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioner seeking appointment of a Sole Arbitrator to adjudicate the disputes that have arisen between the parties in relations to the award of Work in favour of the petitioner for Supply, Installation, Testing and Commissioning of HVAC works at Pre-Clinical Teaching Block for AIIMS within AIIMS Campus, Ansari Nagar, New Delhi by the Respondent vide Work Order No.:-NPPL/ 13/2012/745 dated 13.03.2012.

The disputes having arisen between the parties, the petitioner invoked the Arbitration Agreement as contained in Clause 13 of the Work Order. As the respondent failed to respond to the said invocation, the present petition has been filed.

Learned counsel for the respondent submits that the respondent has no objection if a Sole Arbitrator is appointed to adjudicate the disputes that

have arisen between the parties.

I accordingly, appoint Mr.Pramod B. Agarwala, Advocate, 110, Lawyers Chambers, Delhi High Court, New Delhi, Mob. No.9999105066 as the Sole Arbitrator to adjudicate the disputes between the parties. He shall give his disclosure statement in terms of Section 12(1) of the Act before proceeding with the reference.

The petition is allowed in the above terms with no order as to costs. Dasti.
