This petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Letter of Offer dated 19.09.2014 issued by the respondent in favour of the petitioner.

The Arbitration Agreement is contained in Clause 22 of the General Conditions of Contract in the Tender Document. 3.

Disputes having arisen between the parties, the petitioner invoked the Arbitration Agreement vide its notice dated 09.04.2016. 4.

I have been informed that in another matter raising similar

issues, the parties have been referred to the Delhi International Arbitration Centre (DIAC) for appointment of an Arbitrator for adjudication of their disputes.

DIAC has appointed Mr.S.Raghunathan, IAS (Former Chief Secretary) as the Sole Arbitrator.

Counsel for the respondent submits that the respondent has no objection for appointment of a Sole Arbitrator. Infact, he prays that the disputes raised in the present petition be also referred to the same Arbitrator as has been appointed in the arbitration proceedings being conducted under the aegis of the DIAC.

In view of the above, I appoint Mr.S.Raghunathan, IAS (Former Chief Secretary Delhi), A-61, Gulmohar Park, New Delhi49, Mobile 9810116055, as the Sole Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Letter of Offer dated 19.09.2014.

The arbitration proceedings shall be conducted under the aegis of the DIAC and shall abide by its rules as to the procedure and fees. 8.

The petition is disposed of with the above directions, with no order as to costs.
