versus DVB EMPLOYEES TERMINAL BENEFITS AND ORS.

..... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 07.12.2018 CM No. 51610/2018 1.

Allowed, subject to all just exceptions.

W.P.(C) 13270/2018 2.

The petitioner has filed the present petition, inter alia, impugning a communication dated 6/7.09.2018, whereby the petitioner's claim for reimbursement of medical bill for a sum of 95,107/- incurred for the treatment of the petitioner's late mother has been rejected. A plain reading of the said order indicates that it does not provide any reasons for such rejection.

Mr Pushkarna, learned counsel appearing for respondent no.1 fairly states that a fresh communication would be issued to the petitioner clearly indicating the reasons for denial of such reimbursement.

3.

In view of the above, the impugned communication is set aside and respondent no.1 is directed to consider the petitioner's claim afresh as expeditiously as possible and preferably within a period of four weeks from today.

If the petitioner is not found entitled to such reimbursement, the same would be communicated to the petitioner clearly indicating the reasons for rejection of his claim.

4.

The petition is disposed of in the aforesaid terms. VIBHU BAKHRU, J DECEMBER 07, 2018 MK
