% 05.01.2018 The petitioner has filed the present petition seeking initiation of contempt proceedings against the respondent contending that reply has not been filed despite opportunity being granted on 31.01.2017 and 18.08.2017.

In my view no ground to initiate contempt proceedings is made out. Liberty was granted to the respondent to file reply. In case he does not in compliance of the order, file the reply, the consequences of the same would follow. Mere non-filing of the reply, when liberty is granted does not, in my view, amount to contempt of court. There is no merit in the petition. The petition is accordingly dismissed.
