O R D E R

% 21.01.2019 Learned counsel for the petitioner seeks to place on record the copy of the Rent Control Revision Petition bearing no. 439/18 in which the submissions herein have been reiterated assailing the order dated 09.11.2017 in RC ARC no. 4430/16, which has been assailed in the present petition as well wide which the tenant i.e. the respondent to the present petition had been granted an opportunity to lead additional evidence and to summon witnesses and the petitioner i.e. the landlord was granted an opportunity to get one date of hearing for cross-examination of the witnesses as the matter pertains to the year 2009.

During the course of the submissions that have been on behalf of the respondent to the present petition it has been submitted that the said eviction petition RC ARC no. 4430/16 has already been disposed of and has been dismissed and that the witnesses that had been produced by the respondent / tenant had also been cross examined by the petitioner / landlord. CM(M) 1464/2017

Through the submissions that have been made on behalf of either side, it is brought forth that the Rent Control Revision Petition bearing no. 439/18 against the judgment dated 24.05.2018 of the learned Trial Court, South West, Dwarks Courts, New Delhi is pending.

It is righty submitted on behalf of the respondent that the present petition has become infructuous and thus disposed of as such despite the submissions made on behalf of the respondent to the effect that the proceedings in the matter be placed before the Court concerned dealing with the Rent Control Revision Petition.
