A Special Leave to Appeal under Section 378(3) of Cr.P.C has been filed on behalf of the Petitioner challenging the Judgment dated 30.04.2012 of learned ASJ upholding the judgment dated 05.07.2010 of learned M.M, New Delhi in case FIR No.537/2003 under Section 509 IPC registered at Police Station Tilak Marg, New Delhi.

It is submitted in the Petition that the learned Trial Court has ignored that there are specific allegations against all the accused persons which have been proved on the face of it.

In view of the reasons given in the Special Leave Petition, the same is allowed and stands disposed of accordingly.

An Appeal under Section 378(3) of Cr.P.C has been filed on behalf of the Appellant challenging the Judgment dated 30.04.2012 of learned ASJ upholding the judgment dated 05.07.2010 of learned M.M, New Delhi. 5.

Learned counsel for the Petitioner submits that the main Counsel is busy in another Court.

Learned counsel for Respondent No.2 also states that the main Counsel is not available.

The record shows that the FIR pertains to the year 2017 and the first acquittal was made by learned ASJ on 30.04.2012. The matter is lingering for no rhyme or reason. These kind of adjournments which have been consistently taken are erroneous and not merited under law. 8.

Considering the age of the Appeal, the matter is Reserved for Orders. 9.
