% 09.04.2018 1.
Pursuant to our last order, Mr.Vishwendra, Deputy Commissioner, South Delhi Municipal Corporation is present in Court. A status report dated 6th April, 2018 has been filed before us under the signatures of Shri Rahul Singh, Assistant Commissioner, South Zone, SDMC, placing the latest action taken report. 2.
So far as the fifth property noted in para 2 of our order dated 22nd March, 2018 is concerned, the writ petition made no grievance, and for this reason, the respondents had not responded to the allegations for that property. It is explained that the
complaint was filed with the Building Department and as soon as the same was brought to attention, necessary action was taken. 3.
As far as the Action Taken Report is concerned, it shows that the respondents have taken some action, the same is yet to be completed. The photographs placed on record would also show that as a result of demolition, certain repairs have to be effected on the land which stood encroached upon.
4.
In view of the fact that the respondents are taking action in accordance with law, this writ petition need not detain us any further. The writ petition is, therefore, disposed of with a direction to the South Delhi Municipal Corporation to ensure that all the encroachments are completely removed and that the necessary repairs effected on the land.
5.
It shall be the responsibility of the SDMC to ensure that the encroachments on public land are not resumed. 6.
The SHO, Police Station CR Park, Delhi is directed to assist the SDMC in ensuring compliance of our above order. 7.
The writ petition is disposed of.
8.
In view of the order passed in the writ petition, all the applications are hereby dismissed.
