O R D E R

% 21.12.2017 The petitioner seeks interim bail to attend to his wife who is stated to be suffering from schizophrenia and has been admitted to a hospital now and then. This has been verified by the police. According to this Status Report filed by the respondent, the petitioner's wife was admitted to Kesar Nursing Home on 18th November, 2017 and was discharged from there on 23rd November, 2017. She is stated to be still under treatment for schizophrenia. Opposing the interim bail, Mr. Amit Chadha submits that the petitioner has a son and a daughter to take care of his wife. It is submitted that the petitioner's son is pursuing B.Com through

correspondence and his daughter is pursuing M. Tech. from BITS Bangalore. It is further submitted that at present the wife of the petitioner is at home and taking medicines prescribed by the doctor, hence she could well be looked after by her son, who would be available at home.

The son and daughter of the petitioner are busy in pursuing their studies and it would not be always possible to spare time to look after their mother. Although they may want to be with their mother most of the time, however, keeping in view their age and other preoccupations of youth, which they may have, it may not always possible for them to be in attendance for their mother. Besides, she would require the occasional assistance of an elder member of the family. In the circumstances, the petitioner is directed to be released on bail for a period of three weeks from the date of his release subject to his furnishing a personal bond in the sum of Rs.

intimation to the Trial Court concerned.

The petition stands disposed off in the above terms Nothing stated in this order shall be deemed to be an adjudication on the merits of the case.
