% 06.12.2017 Without prejudice to his rights and contentions, learned counsel appearing on behalf of the petitioner/Allahabad Bank, seeks leave to withdraw this appeal, while reserving liberty to address all legal submissions as have been canvassed before us, in the proceedings in Appeal No. 397/2017, which is pending adjudication before the DRAT and is now slated for hearing on 13.12.2017.

The learned DRAT is however requested to dispose off the Appeal no. 397/2017 arising out of S.A. No. 64/2017 (DRT-II, Delhi) titled as Allahabad Bank vs. Bharat Bhushan Sharma, as expeditiously as possible and preferably on the next date of hearing itself, after hearing counsel for the parties, in accordance with law and deferring any coercive steps that may be warranted till the disposal of the said appeal.

Leave and liberty granted.

The appeal is dismissed as withdrawn along with all pending applications and disposed off accordingly.
