Crl. M.C.No.5249/2017 The instant petition has been filed by the petitioners seeking quashing of Complaint Case No.1049/1/14 for the offences punishable under Sections 323/341/506(II)/509/34 of Indian Penal Code, 1860 (in short „IPC‟) and the proceedings pursuant thereto on the ground that a compromise/settlement dated 20.11.2017 before Mediation Centre, Saket Courts, New Delhi, has been arrived at between the parties in the matter. Respondent No. 1 is present in Court today and is identified by counsel. He states that he has settled the matter with the petitioners of free will and choice without any threat, pressure and coercion, as per CRL.M.C. 5249/2017
settlement/compromise/order dated 20.11.2017 Mediation Centre, Saket Courts, New Delhi.
Statements of the parties have been recorded separately. In view of the fact that the parties have amicably resolved their differences voluntarily and of their own free will and without any coercion, pressure, and no useful purpose will be served in continuance of the proceedings. It would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. Consequently, Complaint Case No.1049/1/14 for the offences punishable under Sections 323/341/506(II)/509/34 of Indian Penal Code, 1860 (in short „IPC‟) and proceedings pursuant thereto are hereby quashed. However, the petitioners are burdened with costs of Rs.15,000/- (Rupees Fifteen Thousand only) to be deposited in Advocate‟s Welfare Fund, Delhi High Court. Cost deposited. Receipt is placed on record. The petition is disposed of.
