% 24.01.2018 The minor daughter of the petitioner Vandana has been located and produced before the Court. We have interacted with Vandana in chamber and thereafter we had also called the petitioner's mother in chamber and interacted with both of them. Vandana states that she does not wish return with the petitioner.
Looking to the aforesaid circumstances and the fact that Vandana is a minor aged about 15 years only, there is no other option but to direct that she would continue to be provided shelter at Nirmal Chhaya, where she presently is. It shall be open to the petitioner to meet her daughter provided Vandana is willing to meet the petitioner.
In case Vandana communicates her desire to return to the petitioner at any point of time, the same should be communicated to the petitioner by the authorities at Nirmal Chhaya, so that she could take her daughter back. Learned counsel for the petitioner has pointed out that in the status report, in para 6, it is stated that information was received from Vandana's counsel, whereafter she was recovered from Dwarka Court Complex. However, it is not disclosed as to who the said counsel was and who had engaged him considering that Vandana is only a minor. The I.O. shall make a complete disclosure to the petitioner in this regard.
