Learned senior counsel for plaintiff has no objection to the same. Consequently, the present review petition and application are

disposed of with a clarification that the Court in which the new plaint is filed shall decide the matter on its own merits without being influenced by any observation made by this Court or the factum of extension of the interim order by this Court.
