% 06.12.2017 Complainant has alleged in the FIR that at about 10:45 pm somebody rang the bell of his house and when his wife opened the door two boys told her that complainant be sent out as they have to take money from him. His wife came inside the house to convey it to her husband (complainant). After sometime they heard sound of two gun shots coming from the corner of their house.
Learned counsel for the petitioner submits that co-accused Rizwan was arrested. As per the investigation, name of petitioner has surfaced in the disclosure statement of Rizwan. Further that, it is Rizwan who along with Aziz Khan had gone to the house of complainant, where Rizwan had fired two gun shots.
Co-accused Aziz Khan has already been granted bail. Therefore, it is prayed that petitioner may be granted anticipatory bail.
Learned APP submits that in the disclosure statement of co-accused Rizwan it is revealed that petitioner had hired the co-accused and is the mastermind of the whole incident.
Keeping in mind the totality of the circumstances, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `20,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station.
Bail application is disposed of in the above terms. Dasti.
