% 12.12.2018 In this petition, contempt of order of 18th September, 2018 is alleged.

Upon notice, learned counsel for respondents submits that in compliance of the aforesaid order, respondents have passed the order of 22nd November, 2018, which is at page No.23 of the paper-book. Learned counsel for petitioner submits that the show-cause notice has not been amended to ensure participation of petitioner in the adjudication proceedings.

Learned counsel for respondents submits that respondentCommissioner of Customs was directed to consider amending of the show-cause notice and there was no positive direction and reasons for not amending the show-cause notice have been provided in the order of 22nd November, 2018. In light of aforesaid, this petition is disposed of with liberty to petitioner to assail the order of 22nd November, 2018 before the CONT.CAS(C) 935/2018

appropriate Forum.
