The instant application under Section 151 of the Code of Civil Procedure, 1908 has been filed on behalf on behalf of the applicant seeking directions for releasing of the amount in favour of the daughters of the deceased respondent no. 1.

Learned counsel appearing on behalf of the applicant submitted that the learned Court of ACJ-Cum-CCJ-ARC (North), Rohini Court, Delhi passed an order in the succession petition under Section 372 of the Indian Succession Act, 1925 for grant of succession certificate in respect of debts and securities, shares etc. maintained in UCO Bank in the name of Late Smt. "8. Thus, considering that the petitioners are the legal heirs of the deceased being her daughters, petitioners are held equally entitled (i.e. 50% share each) to the succession certificate in respect of the Saving Bank A/c Number 18720110034279 and 54 FDRs, total amounting to Rs. 20,78,135/- lying in UCO Bank, Rohini Sector-14, Rohini Delhi and UCO Bank, Delhi High Court Branch in the name of deceased Smt. Vidhya Devi along with accrued interest, if any."

It is submitted that in view of the said order, the reviewing authority has issued the succession certificate in favour of the two legal heirs i.e. two daughters namely Dimple and Anita. It is further submitted that the amount is lying deposited in Saving Bank Account and FDRs in UCO Bank, Delhi High Court in the name of deceased Smt. Vidhya Devi and prayed that the same may be released in favour of the two surviving daughters i.e. legal heirs of the deceased respondent no. 1.

Heard learned counsel appearing on behalf of the applicant and perused the order passed by the concerned Court in the succession petition as well as succession certificate issued by the reviewing authority. 5.

This Court has also perused the contents of the instant application and the death certificate of the deceased respondent no. 1 is also on record. 6.

In view of the above facts and circumstances and for the sufficient cause being shown in the application, this Court is inclined to allow the instant application.

Accordingly, the Manager, UCO Branch, Delhi High Court is directed to release the amount and FDRs lying deposited in the saving account of deceased Vidya Devi having account bearing No. 18720110034279 in favour of the applicants/daughters namely Dimple and Anita equally in their The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
