RC.REV. 569/2017, C.M. Appl. No. 45610-45611/2017 After some hearing on the revision petition filed against an order dated 7th September, 2017 passed by the Additional Rent Controller in eviction case No.E-81022/16 titled as Smt.Raj Kumari V. Smt. Raj Rani, it is submitted by learned counsel for the petitioner that the petitioner will be satisfied if some more time is given to vacate the premises. However, learned counsel for the petitioner says the petitioner must make payment of user charges as per the market rate of rent since after the eviction order. After some deliberations the respondent has agreed to allow the petitioner to remain in the premises for nine months from today provided the petitioner pays the user charges @ Rs.3,000/- per month w.e.f. 1st December, 2018 every

month, payable by the 7th day of each calendar month besides the water and electricity charges as per the actual. As such the petitioner shall vacate the premises on or before 17th September, 2019. The petitioner shall give undertaking to this effect. In case the petitioner fails to file the undertaking or make payment as above the respondent shall avail his right to pursue the execution petition to recover the possession of the premises forthwith.

The petition along with pending applications stands disposed of in terms of the above. Pending application if any, also disposed of. Order dasti.
