By this application filed under Section 439 of Cr. P.C., the petitioner seeks interim bail in FIR No. 181/2017 under Sections 302/324/34 of Indian Penal Code registered at Police Station Malviya Nagar, South Delhi. 2.

The brief and relevant facts to dispose of the present application is that on 05.05.2017, the petitioner along with his associates armed with knife and danda entered the house of Gaurav and started giving beatings to the complainant and his friends which resulted in death of Aman @ Gaurav. 3.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the case and has no role to play; that he is in judicial custody since 08.06.2017; that investigation has been completed and charge sheet has also been filed; that petitioner seeks interim bail to attend the marriage of his elder brother to be solemnised on 10.12.2017 and he wishes to be part of the same.

Heard. Record perused.

The date of marriage of brother of the petitioner has already been verified by the State before the Trial Court and same finds mention in the impugned order dated 27.11.2017.

Keeping in view the facts and circumstances of the present case, the petitioner is directed to be released on interim bail from 09.12.2017 to 11.12.2017 subject to :

i.

That petitioner shall furnish a personal bond in the sum of Rs.30,000/- with one local surety of like amount to the satisfaction of the concerned Trial Court;

ii.

That the petitioner shall not directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the present case so as to dissuade them from disclosing such facts to the Court or to any other authority; iii.

That the petitioner shall surrender before the concerned Jail Superintendent, immediately after expiry of the period of interim bail.

iv.

That the petitioner shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent; 7.

Application stands disposed of.
