O R D E R

% 08.01.2018 The appellant's grievance is that the learned Single Judge disposed of the writ petition according its withdrawal, and later, while deciding the application for review of the order, considered the merits.

The learned Single Judge, by the subsequent order on 20.03.2017 was of the opinion that no direction could be issued, since the licence issued to the appellant for operating the Chandni Chowk Sewa Permit was based upon the ban to the plying of cycle rickshaws in the Chandni Chowk area. That ban was subsequently set aside/revoked by the Government of NCT of Delhi pursuant to a Full LPA 801/2017

Bench decision. In view of this changed circumstance, the learned Single Judge was of the opinion that the directions sought could not be given.

This Court is of the opinion that the appellant's application for licence for the mini bus, if made for any other area, may be considered, on its merits, at the earliest convenience of the Government Agencies. Subject to this, the Court is of the opinion that there is no infirmity in the order of the learned Single Judge. The appeal is disposed of in the above terms along with pending applications.
