By an order passed today in ARB.P. 789/2017, an Arbitral Tribunal has been constituted. In this view, the learned counsel for the parties state that the present petition may be disposed of by directing that the same be considered as an application under Section 17 of the Arbitration and Conciliation, Act 1996. It is so directed.

The learned counsel for the petitioner is at liberty to place a copy of the present petition before the Arbitrator. The Arbitral Tribunal shall consider the same in accordance with law.

It is clarified that all contentions of the parties are reserved. 4.
