O R D E R

% 07.03.2018 By this petition, petitioner seeks anticipatory bail in case FIR No. 319/2017 under Sections 354/307/376/377/442/498A/406/420/34 IPC and Sections 3 & 4 of Dowry Prohibition Act.

The petitioner is the husband of the complainant who alleged harassment and torture by the petitioner and in-laws for demand of dowry. The complainant also alleged that the petitioner created fake video of her and a person namely Darwin, based on which he wanted to take divorce from her.

Matter was referred to mediation before the learned Trial Court, however, the parties could not arrive at settlement. To show his bona fides petitioner states that since there is minor child namely Abhika Goel, he would like to deposit some amount in a fixed deposit for her benefit.

He states that he will deposit ₹5 lakhs in the name BAIL APPLN. 2527/2017

of Registrar General of this Court without prejudice to his rights and contention as well as the complainant.

Considering the allegation in the FIR and that the petitioner is showing his bona fides, this Court deems it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the arresting officer/SHO concerned further subject to the condition that he will join the investigation as and when directed and will not leave the country without prior permission of the Court concerned and in case of change of residential address the same will be intimated by way of affidavit to the Court concerned. As undertaken the petitioner will deposit a sum of ₹5 lakhs within four weeks from today with the Registrar General of this Court.

The amount so deposited by the petitioner with the Registrar General of this Court will be kept in a fixed deposit and will be subject to the final outcome in the trial or settlement arrived at between the parties, if any, without prejudice to the rights and contentions of the petitioner as well as the complainant.

Petition is disposed of. Order dasti.
